  • Affidavit from the Driver

    Note: describing the final minutes of a 15 minute ride that he gave to two friends.

    As I was approaching the stop sign at Quicksilver and Pleasant Valley I
    saw an unmarked police behind me. When we got to the intersection
    I saw a gray unmarked police car pass Quicksilver southbound on
    Pleasant Valley and then back up real fast. I stopped at the stop
    sign and the gray police car pulled in front of me. When the
    police car stopped in front of me I just stayed where I was. Rick
    and Daniel said something like, "Oh Shit!" and they got out and started
    running. I heard a female voice yell to Rick an Daniel by name
    and tell them not to run. A female officer who was wearing a
    yellow top came to my side and opened my door. She placed her
    hand on my arm she told me to get out of the car. I then asked
    her if I should put it in park. Right after I put the vehicle in
    park, I heard the gunshot…

  • Affidavit of Kenneth Lee Connor

    Note: from a police officer who was assisting in the undercover operation.

    I observed Shelly at the drivers side door attempting to get the driver
    out of the Chevrolet. I parked my marked police unit in the
    street on Quicksilver and got out quickly and told Shelly that I was
    coming to help. As I was running towards the drivers side of the
    Chevrolet SUV I could hear other persons yelling and what sounded like
    a struggle on the passenger side of the Chevrolet SUV. Just as I
    got to the driver’s side door I heard a "pop" noise from the passenger
    side of the the Chevrolet SUV and I thought that someone had used their
    Tazeer on the subject. I heard someone make a grunting type sound
    as I have heard when someone gets Tazed. I started around the
    front side of the Chevrolet SUV to see if they needed assistance and I
    heard Julie say "I shot him". I could see Julie standing to the
    east of an unknown male who was laying face down on the ground and Sgt.
    Doyle was on his knees on the west side of the subject….

    Connor says he saw blood on Rocha’s back left. Schroeder
    handed him her gun saying ‘take it’ and he placed it on the seat of her
    car. He noticed a Tazer approximately 6 feet to the west of Daniel.
    Next to the door that Daniel had exited, he noticed a bag of marijuana.

  • Affidavit of Ricardo Villa Ulfeng

    Note: this is the testimony of the passenger who leaped the
    fence. He admits that he was selling marijuana to [X name
    withheld by editor] while under surveillance by undercover cops.

    After doing so, we left and were headed to [D’s name withheld by
    editor] house. He lives off Honey Bee Bend. On the way over
    to [D’s] house, the three of us were smoking a blunt, marijuana.
    We had smoked a couple of blunts. We were on Quicksilver and S.
    Pleasant Valley when I noticed a car behind us. I had not been
    paying attention and did not realize that it was a police officer
    behind us. I then saw an undercover car drive onto Quick Silver
    and then backed up and got in front of the Suburban that we were
    in. I told [E name withheld by editor] and Daniel that I was
    leaving. By that I meant that I was going to take off.

    [E] was driving, I was in the front passenger seat, and Daniel Rocha
    was in the back seat sitting in the center. I immediately opened
    the door and ran out. I started to jump the fence when I heard
    the officer call me by my name and say "Stop Ricky". I remember
    looking back and seeing Daniel’s face looking at me….

  • Affidavit of Michelle Borton

    Note: the affidavit of Schroeder’s car partner that night begins
    with descriptions of the drug operation surveillance and identification
    of a ‘light colored’ suburban vehicle that had been seen at he
    house. While Sgt. Doyle follows the suburban, Schroeder takes
    another route in an effort to head it off.

    I believe Officer Shroeder put our unit into reverse, onto S. Pleasant
    Valley and decided to initiate a stop on the vehicle as it stopped at
    the stop sign. Our emergency lights were activated and I believe
    I advised Sgt. Doyle on channel 6B. Officer Schroeder positioned
    our unit facing the SUV. I got out of our unit and approached the
    driver of the SUV with my hands free. It is important to note
    that I did not see Officer Schroeder get out of our vehicle and can not
    say whether she had her duty weapon in her hand at this time.
    While getting out of our unit, the front passenger got out and jumped
    over a wooden privacy fence approximately five feet to the south where
    the vehicle was stopped. I heard Officer Schroeder say something
    to the affect "Stop [C name withheld by editor]." I had my
    flashlight shining into the vehicle as I approached the driver. I
    began to give verbal commands to the driver to have him show his
    hands. During this time I saw the back right passenger. I
    immediately knew the subject to be Daniel Rocha and gave a verbal
    command for him to stay in the vehicle. I know Rocha from working
    Southeast Austin and have encountered/arrested him several times.
    Officer Schroeder and I spent 6/8/05 and this day 6/9/05 looking for
    Rocha as he was wanted for Felony Theft. While giving verbal
    command to Rocha and attempting to watch the driver, I saw Rocha open
    the back right door where he was sitting. As he got out of the
    vehicle, I immediately observed Officer Schroeder tangled up with him
    as it appeared that he was trying to move past her. This
    encounter is best described as Rocha attempting to run through
    her. I saw Sgt. Doyle run up and begin to assist Officer
    Schroeder. I could see them both attempting to gain control of
    Rocha, but were actively engaged in a physical fight on the opposite
    side of the vehicle. My field of view was limited, but it
    appeared at one time that all three were going down to the ground….
